DISCRIMINATED AGAINST FOR DISABILITY: THE PROTECTION OF THE HEALTH OF WORKERS IN ITALY.

Most European legal systems, including the Italian one, have reserved for the disabled specific forms of “social protection” (ie quotas for hiring, monetary support, care and treatment services) on the assumption that the condition of disability / diversity can not be overcome.

The new European anti-discrimination laws regarding employment and working conditions, which are covered by the Directive 2000/78 / EC, have introduced a discontinuity with this legislative trend – introducing instead new obligations for employers to make “reasonable accommodation” modifications in the workplace, the organization and also with the working conditions of people with disabilities in order to include them in the work environment and enable them to participate fully in the life of the corporate community.
