BOLOGNA – The Court of Appeals has confirmed the ruling of the first instance which sided with the low cost carrier in their dispute with the Labour Inspectorate. “A historic decision,” says a lawyer.

The territorial labour inspectors contested the Irish company’s non-communication of recruitment and non-delivery of certain documents required for enrollment with INPS and INAIL, resulting in a Euro 100,000 sanction. However, the civil court in September, and last week in the Court of Appeals, sided with Ryanair that for their activities on the airplanes they apply the Irish social security regime.

“It is a decision of historical importance,” explains Sofia Bargellini, an Associate of the Italian employment law firm Lexellent. “ There are similar cases throughout Italy, for hundreds of workers and for tens of millions of euro under dispute – but the ruling in Bologna is the first sentence of the second degree and establishes a precedent for all of the other cases.”
